Ken Scott, with the help of Almighty God and some tremendous lawyering, won the day in a federal court hearing in Denver, Colorado, this past Friday, January 27, 2012,  as District Judge Philip Brimmer rejected an attempt by the federal government to grant Planned Parenthood preliminary injunctive relief from Ken Scott.  This Preliminary Injunctive Hearing was meant to keep Ken outside a 25’ imaginary bubble from the entrance of the Planned Parenthood of the Rock Mountains abortion mill.

God showed up and showed off at this blatantly unconstitutional attempt by our own federal government to remove the gospel of Christ from the gates of hell – local abortion mills across this country.

Judge Declares Ken Scott a “Sensible Man”

Thursday January 26th, U.S. District Judge Philip Brimmer denied the Justice Department’s allegation that Kenneth Scott’s sidewalk counseling efforts at Planned Parenthood in Denver make it “unreasonably difficult” for patients and employees to get to the clinic.  If the Justice Department had proven that Mr. Scott was guilty of their charges, he would have been saddled with a preliminary injunction that would keep him 25 feet from the driveway.  Instead, Judge Brimmer, stated that Mr. Scott is a “sensible man” as he ruled against the preliminary injunction in the U.S. vs. Kenneth Scott FACE civil lawsuit.

Mike Wagner, head security guard for Planned Parenthood of the Rocky Mountains appears in a video that the government produced as evidence against Scott.  The video shows Kenneth handing a client an information packet and Wagner driving up behind the vehicle stopped in the driveway.  Mr. Wagner testified that he felt “frightened and concerned” while he waited ten seconds to get into the driveway.  No police report was filed.  Wagner carries a gun, he has extensive military training and he’s a former police officer.  He is now the head of security for the entire Rocky Mountain region Planned Parenthoods.  Unless Mr. Wagner is deathly afraid of paper cuts, it makes one wonder why an abortion client receiving an information packet would cause him to panic.  Even Judge Brimmer, while explaining his ruling expressed his doubt in the former police officer’s credibility.  For these reasons, Mike Wagner is the reluctant recipient of “Best Hostile Witness of Day” award. 

When questioned by Scott’s lawyer, Mike Wagner said he wasn’t aware of any fender-benders caused by Scott.  Ironically, there was quite a wipe out two years ago during a snow storm as Mr. Wagner raced around the corner at Planned Parenthood and plowed into two cars.  Both of the cars belonged to pro-lifers who were praying across the street from the abortion facility. 

Ken Scott’s witnesses were exemplary.  Binette Bah, in particular, captured the attention of the court when she and her four year old daughter entered the room to testify.  Adorable little Binette was heading to the witness stand with her mom and had to be directed to sit in the gallery. The entire courtroom watched as she stood in her seat to see mommy. 

On the witness stand Binette was asked how she knew Ken Scott.  “I met Ken Scott at Planned Parenthood the day I went for an abortion.”  Before Binette finished her testimony she instructed the people in the courtroom to look at her daughter and said, “If it weren’t for Ken Scott my daughter would not be here today.”  When Binette left the witness stand little Binette ran to her mom and hugged her.  It was a sweet sight to behold.

The process of preparing for the injunction hearing and the subsequent $10,000 Federal FACE law suit coming later this year has been grueling for both Kenneth and his attorneys.  The Federal Government has a battery of lawyers working to protect the abortion industry in Colorado from the truth.  If not for the diligent, self-sacrificing work of Rebecca Messall, along with Peter Breen and Tom Brejcha of the Thomas More Society out of Chicago, the outcome would have been very different. 

The left slanted media in Colorado invariably portrays the pro-life movement in the worst possible light. But that is not always the case.

For the past decade, KPOF, a local Denver Christian radio station, has consistently invited Ken and Jo Scott to their program.  Today, Roy Henchke and Denise Washington Blomberg told Ken that since they have been broadcasting the events at the abortion mill their listeners view the pro-life ministry differently than they did in the past.  The audience has invested their prayers in the ministry and they are genuinely concerned about the welfare of the sidewalk counselors.  No longer does the Christian community view the pro-lifers at the abortion mills as judgmental, aggressive or hateful.  KPOF is changing the world for Jesus and helping to save the lives of innocent baby boys and girls while providing an important outlet for the truth to be shared. 

The U.S. Justice Department under Barack Obama is targeting free speech outside of abortion mills in at least seven states.  In doing so they are jeopardizing the lives of thousands of children and their moms. Do not be deceived, free speech everywhere is at risk when the government decides who is allowed to speak and where that government approved speech takes place.  Please pray for our leaders, especially President Barack Obama and the head of the Justice Department, Eric Holder, to come to know our Lord and Savior Jesus Christ.

A Judge in Florida has finally ruled on the Freedom of Access to Clinic Entrances Law (FACE) and the illegal collusion between the Justice Department (DOJ) and the abortion industry.  This ruling will be a great help to all of us who are faithfully bringing the Gospel of Jesus Christ to the gates of hell (local abortion mills) in the streets of our own cities.  This should be great news to Ken and Jo Scott who are being charged with the very same thing in Denver.

This is an incredible story.  Brothers and sisters the battle is on, and men of good faith are being dragged off to jail because of their witness for King Jesus.  New York City Mayor Michael Bloomberg is a fool, “The fool says in his heart, ‘There is no God…’”  Psalm 14:1, and is doing all in his power to silence the Gospel of Christ.  This must not stand!

A remarkable story is unfolding in New York City. 

Churches that have been meeting in schools there will have to find new places of worship by Feb. 12, when a new law banning the churches from public school facilities goes into effect.  The new ban will affect about 150 churches.

So when Mayor Michael Bloomberg gave his State of the City Address on Thursday, more than 200 pastors and lay people gathered outside the Bronx school where he gave the speech to pray.  Police arrested 43 of the praying protesters.

being handcuffedA Denver pro-lifer has gained the support of a legal group that believes he’s being targeted by the U.S. attorney general simply because of where he stands on the issue.

Kenneth Scott is being prosecuted based on the Freedom of Access to Clinic Entrances (FACE) Act, which is designed to keep pro-lifers from blocking access to abortion clinics. But Peter Breen of the Thomas More Society tells OneNewsNow Scott is accused of obstruction, which appears to be an obscure interpretation of federal law.

“It appears to be based on the fact that when he waves someone to come over and talk to him and to pull over to take literature about offering alternatives to abortion, that the car that is stopped [so people can talk] to Ken might have obstructed some other car that would be waiting to get into the parking lot to have an abortion,” he explains.

Breen 2But he points out that when the lead car leaves, the people in the vehicles supposedly behind it still have full access. So he suggests that if someone were selling flowers on a right of way, for example, not one eyebrow would be raised.

“These are rights that we have had and [that] have been held sacred in this country from time immemorial — and yet today, the attorney general wants to restrict those rights merely because this sort of interchange of information and ideas is occurring outside of an abortion clinic,” the attorney laments.
The U.S. attorney general’s office has assigned five federal prosecutors to handle the case against Scott, while the Thomas More Society enters the fray with the pro-lifer’s legal team.

FOUNDATION FOR MORAL LAW CALLS ON BRIGHTON, NY POLICE TO STOP HARASSING PRO-LIFE MINISTRIES OUTSIDE ABORTION CLINIC

MONTGOMERY, AL — The Foundation for Moral Law sent a letter to the Town of Brighton in western New York yesterday, demanding that the Brighton police and officials stop interfering with pro-life ministry on the public sidewalks outside a local abortion clinic.  On behalf of Rev. Michael Warren and Gerald Crawford, both of Rescue Rochester, and Bound4Life Rochester, the Foundation told Brighton to “cease and desist” its unconstitutional pattern of targeting multiple pro-life activists in their ministry of prayer and sidewalk counseling.

Judge Roy Moore, President of the Foundation for Moral Law and the former Chief Justice of the Alabama Supreme Court, noted that the Brighton police should be upholding the law: “Those who believe in abortion never cease to try to restrict any opposition to their anti-life agenda. The Brighton police should be upholding the law and the freedom of people to speak up for the God-given right to life rather than running interference for the abortionist.”
 
In the letter, the Foundation explains that Brighton police officers have been making unwarranted threats against Rev. Warren and Mr. Crawford for their lawful use of pro-life signs and amplification equipment outside the abortion clinic of Dr. Morris Wortman, at 2020 South Clinton Avenue in the Town of Brighton.  Additionally, as if to prove their anti-life bias, Brighton police in September ordered members of the pro-life prayer group Bound4Life Rochester to produce identifying information for simply praying silently on the public sidewalk outside the same clinic.
 
“Just as unborn children are targeted by the abortionist on the inside, Brighton police have made a habit of targeting pro-life ministry on the public streets outside the abortion mill,” said Foundation attorney Ben DuPré, who along with local New York attorney Kevin Johnson of Klafehn & Heise PLLC, signed the demand letter.  “However much Dr. Wortman and officials of Brighton may dislike Rescue Rochester’s and Bound4Life’s message or even mere presence, the Constitution does not permit the force of law to be used to harass and intimidate pro-life ministry in Brighton.”
 
Reverend Michael Warren of Rescue Rochester stated, “It is tragic that our judical and law enforcement institutions have been so blinded by the bloodguilt of over 50 million children killed by abortion that they are determined to silence a ministry that offers the one safe choice available to abortion minded women. It’s unfortunate that The Brighton Police Department finds itself co-opted by the pro-abortion political machine. By the grace of God we will continue to be a voice for the voiceless at Rochester area abortion mills.”
 
The letter concluded by demanding from the Town of Brighton written assurances by November 21, 2011, that pro-life speakers will be allowed to freely engage in the expression of their protected speech on the public sidewalks near and adjacent to Dr. Wortman’s abortion clinic.

Dear Champion of the Lord and the Preborn,

Pastor and I had the blessing to be at the Wyoming Supreme Court with our wonderful attorney, Jack Edwards. He did a masterful job defending our rights, while dismantling the city of Jackson’s case against us.

It is amazing to consider that Operation Save America did a regional event in Jackson, WY and six months later it is still reverberating throughout this state. It continues to be front page news.

The city of Jackson was so concerned about this case going before the Wyoming Surpeme Court, they sent the top five leaders of their city to observe it. The mayor, city manger, city attorney who argued their case, and LT. Guillam who sought the TRO/injunction against us were present in the court room. Apparently, they are deeply concerned about the outcome of this case. They are either frightened by a lawsuit or intend to use it again to censor the Gospel light that shines upon the darkness of child-killing tolerated in their city.

As most of you know WY is one of the five states that makes up the States of Refuge campaign. Please continue to pray for this vision and mission. We will be going back to Wyoming and it would be a great blessing to see this TRo/injunction defeated in Jesus’ name!

Wyoming Supreme Court Considers Abortion Case

CHEYENNE, Wyo. (AP) – The town of Jackson violated anti-abortion protesters’ rights when it secured a court order prohibiting them from appearing on the town square, a lawyer told the Wyoming Supreme Court on Thursday.

Laywer Jack Edwards, representing the anti-abortion group Operation Save America, argued that it was improper for the town to secure a court order barring activists from appearing within two blocks of the town square in May. The town didn’t notify protesters beforehand that it was seeking the order.

“There are many procedural errors,” Edwards told the court. “To not rule on this would create a blueprint for the squelching of protected speech in the future.”

Audrey Cohen-Davis, lawyer for the town, argued Thursday that it was proper for the town to secure the restraining order from District Judge Timothy Day.

Cohen-Davis said city police feared possible violence if the protesters, who previously had been showing graphic signs of aborted fetuses around Jackson, came together on the town square with about 200 Boy Scouts and their families who were gathering for an annual auction of elk antlers.

“Parents taking their Boy Scouts to the Elkfest event did not expect to have a group subjecting their children to such material,” Cohen-Davis said.

Police arrested two anti-abortion protesters at the event.

Operation Save America, a national group, said it had picked Jackson for its anti-abortion campaign in an effort to make Wyoming the first state in which no doctors would provide abortions. The group targeted Dr. Brent Blue, a family practitioner, whom the group said is the only doctor in the state to offer abortions.

Justice E. James Burke questioned Cohen-Davis closely about the town’s failure to notify Operation Save America before seeking the court order.

Burke noted that the U.S. Supreme Court has said there’s no place in the law for issuing restraining orders without notice that deprive people of their basic freedoms guaranteed by the First Amendment unless there’s proof it was impossible to notify them and give them an opportunity to participate in the court hearing.

Cohen-Davis responded that she didn’t want Operation Save America protesters to know who she was. She said Jackson was in a very volatile situation when the protesters were in town.

“Isn’t our system sort of based on both sides having an opportunity to present their position to the court?” Burke asked.

Rusty Thomas of Waco, Texas, is assistant director of operations for Operation Save America. He and other members of the group attended Thursday’s court hearing in Cheyenne.

Speaking after the hearing, Thomas said the group had about 40 or 50 protesters in Jackson for five or six days in May. “We felt it was our duty as Christians to make that challenge,” he said.

Thomas said his group was in close contact with Jackson law enforcement during the protest, but received no advance notice the town was going to court to block its demonstration. “They did not make any attempts to tell us,” he said. “We were set up.”

Thomas said the group wants the Wyoming Supreme Court to issue an order saying what the town did was wrong. “What happens when we go back? And we do intend to go back,” Thomas said. “Are they going to pull this out and go after us in the future?”

The court took the case under advisement and will issue a written decision later.
